Terms and Conditions

1. Booking and Payment

A non-refundable retainer is required to secure your event date and time. This retainer will be used towards the total amount due. Bookings are not confirmed until availability is confirmed and the retainer is received. The remaining balance is due directly to the performer(s) the day of the event in cash or anytime before the event date.

2. Cancellations and Rescheduling

Retainers are non-refundable after 48 hours of booking, for ant reason, including illness, weather, or changed in event plans. Rescheduling requests must be made in writing and are subject to Tall Tails and Tiaras availability. One courtesy reschedule may be offered at Tall Tails and Tiaras discretion. Tall Tails and Tiaras reserves the right to cancel or modify services due to unsafe conditions, extreme weather, illness, or circumstances beyond our control. In such cases, a reschedule or refund of payments made may be offered.

3.Weather Policy (Outdoor Events)

For outdoor events, the client i responsible for providing a safe, dry, and shaded performance area. In the event of extreme heat, rain, wind, or unsafe conditions, Tall Tails and Tiaras may modify, shorten, or cancel the performance to ensure performer safety. No refunds will be issued for weather related interruptions once the performer has arrived.

4. Performer Safety and Conduct

For the safety of our performers and guests:

Performers may not be climbed on, pulled, pushed, or handled
Costumes, wigs, props, and stilts may not be touched unless explicitly permitted
Stilt Walkers require clear, level surfaces and adequate space

Swimming Mermaid Disclaimer

Swimming Mermaids and assistants are entertainers only and are not certified lifeguards and do not provide swimming instruction, supervision, or water safety services.

A certified lifeguard or responsible adult swimmer must be present at all times during any swimming mermaid experience. Children must remain under the supervision of parent or designated adult at all times.

Tall Tails and Tiaras and its performers are not responsible for monitoring swimmers, enforcing pool rules, or responding to aquatic emergencies.

Failure to provide proper supervision may result in modification or termination of services without refund.

5. Supervision Requirement

A responsible adult must be present at all times during the event. Tall Tails and Tiaras entertainers are not responsible for child supervision, discipline, or crwod control.

6. Arrival, Parking, and Access

Client must provide clear instructions for parking and event access. Client is responsible for providing free and accessible parking for performers. Any paid parking, parking fees, or valet costs required for event access are the responsibility of the client. Our performers schedule additional time to account for traffic delays, and parking delays, however when certain circumstances arise delays caused by lack of access, parking issues, or incorrect address may reduce performance time without refund.

7. Character Representation Disclaimer

It is not the intention of Tall Tails and Tiaras to violate any copyright laws. Tall Tails and Tiaras provides professionally costumed character performers for entertainment purposes only. Tall Tails and Tiaras offer only original interpretations and are not affiliated with or endorsed by any trademarked or copyrighted brands. If the client is looking for a copyrighted character they should reach out the the company and copyright holders.

8. Photography and media

Tall Tails and Tiaras may take photos or short videos during the event for promotional purposes unless the client notifies us in writing prior to the event.

9. Limitation of Liability

Tall Tails and Tiaras is not liable for injuries, damages, or losses resulting from misuse of props, failure to follow safety guidelines, or lack of supervision. Client agrees to release and hold harmless Tall Tails and Tiaras, its performers, and contractors from any claims arising from the event, except in cases of gross negligence.

10. Acceptance of Terms

By submitting a booking inquiry, signing electronically, and/or making a payment, the client acknowledges that they have read, understood, and agreed to these terms and conditions.
